Welcome to Identity Start LLC ("Identity Start," "Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of this website (the "Site") and, where noted, the services we provide.
By accessing or using this Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Descriptions of services, packages, and pricing on this Site are provided for general information and are not an offer or a binding quote.
Work begins only after a written proposal, quote, subscription signup, or agreement is accepted. If any term of a signed agreement conflicts with these Terms, the signed agreement controls for that project.
All client work is governed by our Master Services Agreement, which covers scope, payment, revisions, ownership, hosting, and transfers in full. Payments are processed by Stripe, a third-party payment processor. We do not store or have access to your full payment information.

You may not copy, reproduce, distribute, or use any content without prior written permission.
For client projects, ownership of final deliverables transfers to the client upon receipt of full payment, unless the project agreement states otherwise. Identity Start retains ownership of preliminary concepts, unused designs, source project files, and its own templates, systems, and processes. Third-party assets such as fonts, stock media, and plugins remain subject to their own licenses.
Unless you request otherwise in writing, we may display work produced for you, including websites, photography, video, drone footage, and branding, in our portfolio, case studies, social media, and marketing materials.

We are not responsible for the content, privacy practices, availability, or functionality of third-party services. Domain registrars, hosting platforms, and advertising platforms may change their pricing, terms, or policies at any time.
We do not guarantee specific results from design, website, SEO, social media, or advertising services, including rankings, traffic, leads, or revenue. Advertising platforms control ad approval, delivery, and cost, and search engines control how and whether content is indexed and ranked.

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles.
Any dispute arising from these Terms or from your use of the Site shall be brought exclusively in the state or federal courts located in McHenry County, Illinois.
We may update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date.
Your continued use of the Site constitutes acceptance of any changes.

Website engagements consist of a one-time build fee, based on site size and scope, plus a monthly plan. The build fee and any first-build add-ons are invoiced before production begins. The monthly plan begins when the site goes live and continues until cancelled.
Monthly plans have no minimum term. You may cancel at any time with 14 days' written notice before your next billing date. Fees already paid are not refunded.
Your monthly plan covers managed hosting, maintenance, security and software updates, SSL, backups, performance monitoring, and reasonable content edits, plus any marketing services included in your plan tier. The website design, layout, custom code, and creative assets built under a plan are licensed for use on our hosting platform for as long as the plan is active.
When a plan ends, the website is taken offline. We keep your site files and backups for 90 days after cancellation. You may take the site with you by paying the transfer and buyout fee below.
To move your website to another provider or platform, a one-time buyout applies, based on how many months of the plan you have paid:
The buyout covers the export of your site files and project, the domain handoff, and a transfer call. On payment, you receive full ownership of the website files and a perpetual license to all associated creative assets. Delivered media, including photography, video, logos, and brand files, is always yours to keep at no additional cost, whether or not you buy out the site.
If a payment fails, we retry automatically and notify you. If the balance remains unpaid:
Reinstatement within 90 days is $199 plus any missed months. After 90 days, restoring service requires a new build at current rates.
You own your domain name at all times. Where we hold or manage your registration on your behalf, we will transfer it to you or your designated provider within 10 business days of a written request, provided your account is current.
